Welcome to Palabra! These Terms of Service ("Terms") govern your use of the Palabra educational puzzle creation tools ("Service"). By using Palabra, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Palabra, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

2. Description of Service

Palabra is a free educational tool that allows teachers to create custom word puzzles for their students. The Service includes:

Puzzle creation with custom vocabulary words and hints
Shareable puzzle links for students
Draft saving for incomplete puzzles
Puzzle analytics to track student engagement
Pre-built vocabulary templates

3. User Accounts and Subscriptions

Palabra offers optional subscription plans for enhanced features:

Free Tier: Create up to 5 puzzles for free, no credit card required
Subscriptions: Create unlimited puzzles with a subscription
Link to Device: Access your subscription on an additional device by entering your email address - we'll send a verification link to link the device
Subscription billing is handled through Stripe
You can cancel your subscription at any time

4. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Create puzzles with offensive, inappropriate, or harmful content
Attempt to gain unauthorized access to the Service or its systems
Interfere with or disrupt the Service or servers
Use automated scripts or bots to create puzzles
Share puzzles containing inappropriate content with students

Educational Use Policy: Palabra is intended for educational purposes. We reserve the right to remove puzzles or suspend access for users who create inappropriate content or violate these terms.

5. Intellectual Property

The Service and its original content, features, and functionality are owned by Palabra and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of the educational content (words, hints, titles) you create, but grant us a license to store and serve this content to puzzle players.

6. User-Generated Content

When you create puzzles:

You are responsible for ensuring content is appropriate for your intended audience
You grant us the right to store and display your puzzles to anyone with the puzzle link
We may remove puzzles that violate these Terms
Puzzles are retained until you delete them or after 1 year of inactivity

7. Student Privacy

Palabra is designed with student privacy in mind:

Students are identified only by anonymous Player IDs
No personal information is collected from students
Teachers are responsible for appropriate use in their classrooms
We comply with applicable student privacy laws including COPPA and FERPA

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

We do not warrant that:

The Service will meet your requirements
The Service will be available at all times
Puzzles or data will be preserved indefinitely
The dictionary will contain all vocabulary words

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

This includes but is not limited to:

Loss of puzzles or data
Inability to access the Service
Use of puzzles by third parties

10. Modifications to Service

We reserve the right to:

Modify or discontinue the Service at any time
Change features or functionality
Update the dictionary or available templates
Add, modify, or remove features without notice

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the new Terms on this page. Your continued use of the Service after changes constitutes acceptance of the new Terms.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law. You agree to waive any right to participate in class action lawsuits.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.
